Terms of Service

These Terms of Service ("Terms") govern your access to and use of Chatkuy mobile application and services ("Service" or "Chatkuy"). By accessing or using Chatkuy, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use Chatkuy.

1. Acceptance of Terms

By creating an account, accessing, or using Chatkuy, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Chatkuy. If you are using Chatkuy on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Chatkuy is a messaging and social networking application that allows users to:

• Send and receive text messages
• Create and manage profiles
• Create and share posts
• Connect and communicate with other users
• Share images and media files (coming soon features)

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. User Accounts

3.1 Account Creation

To use certain features of Chatkuy, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials (email and password) and for all activities that occur under your account. You agree to:

• Use a strong and unique password
• Not share your account credentials with others
• Notify us immediately of any unauthorized access or use of your account
• Log out from your account when using shared devices

3.3 Account Deletion

You may request deletion of your account at any time through the app settings or by contacting us at privacy@chatkuy.com. Upon account deletion:

• Your account and profile information will be permanently deleted
• Your messages will be deleted (subject to backup retention periods as described in our Privacy Policy)
• You will no longer be able to access your account or any associated data
• Some information may be retained as required by law or for legitimate business purposes

Account deletion is irreversible. Please ensure you have backed up any important information before requesting deletion.

4. Acceptable Use

You agree to use Chatkuy only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service to transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
• Transmit any content that infringes upon the intellectual property rights, privacy rights, or other rights of others
• Transmit spam, chain letters, or unsolicited communications
• Collect or store personal data about other users without their explicit consent
• Use automated systems (bots, scripts) to access or interact with the Service without our prior written consent
• Attempt to gain unauthorized access to the Service, other accounts, or computer systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use the Service to violate any applicable local, state, national, or international law
• Engage in any activity that could harm or exploit minors

4.1 Prohibited Content

The following types of content are strictly prohibited on Chatkuy. Violation of these prohibitions may result in immediate account suspension or termination:

• Pornography & Explicit Sexual Content: Any pornographic material, sexually explicit images, videos, or text, including but not limited to nudity, sexual acts, or sexual solicitation
• Violence & Criminal Activity: Content that promotes, glorifies, or depicts violence, criminal acts, terrorism, or illegal activities. This includes threats of violence, instructions for committing crimes, or content that could facilitate criminal behavior
• Hate Speech & Discrimination (SARA): Content that promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, nationality, gender, sexual orientation, disability, or other protected characteristics. This includes content that incites violence or discrimination (SARA: Suku, Agama, Ras, dan Antargolongan)
• Illegal Drugs & Substances: Content that promotes, sells, or provides information about illegal drugs, drug paraphernalia, or controlled substances. This includes content related to drug manufacturing, distribution, or consumption
• Fraud & Scams: Content designed to deceive, defraud, or scam users, including phishing attempts, fake investment schemes, pyramid schemes, identity theft, or any form of financial fraud
• Copyright Infringement: Content that violates intellectual property rights, including unauthorized sharing of copyrighted material, pirated content, or content that infringes on trademarks, patents, or other proprietary rights
• Hoax & Misinformation: Content that spreads false information, hoaxes, conspiracy theories, or misinformation that could cause harm, panic, or mislead users. This includes false medical information, fake news, or content that could endanger public safety
• Harmful Content: Content that promotes or depicts self-harm, suicide, eating disorders, or other dangerous behaviors. This includes content that could encourage users to engage in activities that pose a risk to their physical or mental health

We reserve the right to remove any content that violates these prohibitions and to take appropriate action, including account suspension or termination, reporting to law enforcement, or other legal action as necessary.

5. User Content

5.1 Content Ownership

You retain ownership of any content you create, post, or share through Chatkuy ("User Content"). However, by posting User Content, you grant Chatkuy a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such content solely for the purpose of operating and providing the Service.

5.2 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that:

• You have the right to post the content
• Your content does not violate any third-party rights
• Your content complies with these Terms and applicable laws

5.3 Content Moderation

We reserve the right, but are not obligated, to review, monitor, edit, or remove any User Content at our sole discretion. We may remove content that violates these Terms or is otherwise objectionable, with or without notice.

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Chatkuy and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

7. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

8. Service Availability

We strive to provide reliable service but do not guarantee that the Service will be available at all times. The Service may be unavailable due to maintenance, updates, technical issues, or circumstances beyond our control. We are not liable for any loss or damage resulting from Service unavailability.

9. Termination

9.1 Termination by You

You may stop using the Service at any time by deleting your account as described in Section 3.3.

9.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, if you violate these Terms or engage in any fraudulent, abusive, or illegal activity. We may also terminate your account if the Service is discontinued.

9.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

10. Disclaimers and Limitations of Liability

10.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHATKUY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify, defend, and hold harmless Chatkuy and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Service, your User Content, or your violation of these Terms.

12. Age Restrictions

Chatkuy is not intended for individuals under the age of 18. You must be at least 18 years old to use Chatkuy. By using Chatkuy, you represent and warrant that you are 18 years of age or older.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of Chatkuy after such modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Indonesia, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through good faith negotiations, and if unsuccessful, through the competent courts of Indonesia.
